What Is IEEPA and Why Are the Tariffs Being Refunded?

IEEPA stands for the International Emergency Economic Powers Act, a U.S. law that grants the President broad authority to regulate international commerce during a declared national emergency. Starting in early 2025, the executive branch invoked IEEPA to impose sweeping tariffs on imports from China, Vietnam, India, Bangladesh, Cambodia, Thailand, and dozens of other countries.

In Learning Resources, Inc. v. Trump, the U.S. Supreme Court issued a final ruling that this use of IEEPA to impose tariffs exceeded executive authority and was unconstitutional. As a result, every dollar of IEEPA tariff duties collected from U.S. importers is legally refundable.

CBP (U.S. Customs and Border Protection) is administering the refunds through a new system called CAPE — Customs Automated Processing Engine. Importers must file a CAPE Declaration to claim their refund. CBP will not automatically identify or pay eligible companies.

How do I know if I paid IEEPA tariffs?
IEEPA tariffs were imposed via executive order on imports from China, Vietnam, India, Bangladesh, Cambodia, Thailand, and many other countries starting in early 2025. If your company was the Importer of Record (IOR) on those entries and paid customs duties, a portion or all of those duties were likely IEEPA tariffs. Your customs broker can pull your CBP entry summaries (CF7501 forms) which show the duty codes. Price Ridge can help you interpret them at no cost.
What is a CAPE Declaration and do I need to file one?
CAPE (Customs Automated Processing Engine) is the system CBP built to process IEEPA tariff refunds, operating within the ACE Secure Data Portal. To receive a refund, the Importer of Record (IOR) or their authorized customs broker must submit a CAPE Declaration — a CSV file listing the eligible entry summaries — through the CAPE tab in ACE. Without one, CBP will not automatically issue your refund. Price Ridge prepares and files this on your behalf.
What does Price Ridge charge?

What documents do I need?
Primarily your CBP entry summaries (CF7501s) for the relevant import periods, along with commercial invoices and proof of duty payment. Most importers can get all of this from their customs broker. If you don’t have a broker relationship, Price Ridge can help you retrieve the necessary records through CBP’s importer query tools.
What if my entries are finally liquidated or went through reconciliation?
Both are now eligible. Phase 2 of CBP’s CAPE system launched June 29, 2026, covering finally liquidated entries and — as a new addition — reconciliation entries. Reconciliation entries are those where value, classification, or other details were not finalized at the time of original filing and were later updated with CBP through a post-entry reconciliation process. If you had complex import activity in 2025–2026, you may have recoverable reconciliation entries you weren’t aware of. Price Ridge reviews your history to identify all eligible entry types.
How long does it take to get the refund?
CBP's current guidance is that valid IEEPA refunds are generally issued within 60–90 days of accepting your CAPE Declaration. Phase 2 (finally liquidated and reconciliation entries) launched June 29, 2026 — the queue is live and growing. The sooner you file, the earlier your position.
