What Is IEEPA and Why Are the Tariffs Being Refunded?
IEEPA stands for the International Emergency Economic Powers Act, a U.S. law that grants the President broad authority to regulate international commerce during a declared national emergency. Starting in early 2025, the executive branch invoked IEEPA to impose sweeping tariffs on imports from China, Vietnam, India, Bangladesh, Cambodia, Thailand, and dozens of other countries.
In Learning Resources, Inc. v. Trump, the U.S. Supreme Court issued a final ruling that this use of IEEPA to impose tariffs exceeded executive authority and was unconstitutional. As a result, every dollar of IEEPA tariff duties collected from U.S. importers is legally refundable.
CBP (U.S. Customs and Border Protection) is administering the refunds through a new system called CAPE — Customs Automated Processing Engine. Importers must file a CAPE Declaration to claim their refund. CBP will not automatically identify or pay eligible companies.

In Learning Resources, Inc. v. Trump, the Supreme Court issued a final ruling: tariffs imposed under the International Emergency Economic Powers Act (IEEPA) were unlawful. Every dollar collected under those tariffs must be refunded.
CBP administers refunds through CAPE (Customs Automated Processing Engine), operating inside the ACE Secure Data Portal (ACE Portal). Only the Importer of Record (IOR) or their authorized licensed customs broker can file. CBP does not automatically identify or pay importers — you must file a CAPE Declaration to claim what you’re owed.
